Terms & Conditions

These terms and conditions govern the relationship between Bendang Tech ("we", "us", "our") and any individual or business ("you", "the Client") who engages our services or uses our website. By submitting an enquiry, agreeing to a scope summary, or making payment, you accept these terms.

1. Definitions

  • Service — any of the three services offered by Bendang Tech: Process Map, Receipt and Invoice Capture, or Small Team Training
  • Engagement — a confirmed agreement to deliver a specific Service, initiated by written scope confirmation and payment
  • Deliverable — the tangible output of an Engagement (process diagram and notes; working spreadsheet and limitations report; training materials and wall checklist)
  • Scope Summary — the written document provided before each Engagement describing what is included, what is not, and what the Deliverable will contain
  • We / Us / Our — Bendang Tech, 76 Jalan Sultan Yussuf, 30000 Ipoh, Perak, Malaysia
  • You / Client — the individual or business engaging our services

2. Acceptance of These Terms

These terms apply when you:

  • Submit a contact form or send an enquiry via email or phone
  • Agree to a Scope Summary
  • Make payment for a Service

You must be at least 18 years old and have authority to enter agreements on behalf of your business. If you are agreeing on behalf of a company, you represent that you have the authority to bind that company to these terms.

3. Service Description and Availability

We offer three services as described on our website and in individual Scope Summaries:

  • Process Map — observation-based mapping of one business process, delivered as a diagram and notes page
  • Receipt and Invoice Capture — a two-week document capture trial for common supplier formats, delivered as a working spreadsheet and limitations report
  • Small Team Training — a full-day on-site training session for up to 12 staff

Services are available primarily to businesses in Ipoh and the surrounding Perak area. We will confirm availability and any travel considerations before agreeing to an Engagement. We reserve the right to decline engagements that fall outside our operational scope.

4. Scope and Deliverables

Each Engagement begins with a written Scope Summary. The Scope Summary defines:

  • What is included in the Engagement
  • What is explicitly outside scope
  • What the Client needs to have ready before we begin
  • What the Deliverable will contain and its format
  • Expected timeline

If we discover during an Engagement that the scope is wider than described (more document types, more complex process branches, more staff than stated), we will notify you before continuing and confirm any change to scope or price.

5. Payment Terms

  • All prices are in Malaysian Ringgit (RM)
  • Current prices: Process Map RM 132 · Document Capture RM 375 · Team Training RM 660
  • Payment is due in full before an Engagement begins, unless otherwise agreed in writing
  • Payment methods: bank transfer to details provided in invoice
  • Prices are subject to change; the price confirmed in your Scope Summary is the price you pay for that Engagement

6. Cancellation and Refunds

  • Cancellation more than five working days before the start of an Engagement: full refund
  • Cancellation two to five working days before start: 50% refund
  • Cancellation less than two working days before start: no refund, unless we are unable to fulfil the Engagement
  • If we cancel an Engagement for reasons within our control, you receive a full refund
  • Cancellation requests must be made in writing to [email protected]

7. Client Responsibilities

  • Provide accurate information about your business processes and document types before the Engagement begins
  • Ensure that staff and premises are accessible during agreed observation or training days
  • Not share third-party confidential data (customer personal data, client agreement details) with us without informing us of its confidential nature
  • Use Deliverables only for internal business purposes
  • Not represent our Deliverables as your own original work when sharing with third parties without attribution

8. Intellectual Property

Deliverables produced for you are licensed to you for internal business use. We retain the intellectual property in any underlying methodology, templates, or standard materials. You may not resell Deliverables or use them as the basis for offering competing consulting services.

Training materials and wall checklists are provided for use within your business. They may not be reproduced for distribution to other businesses without our written consent.

9. Confidentiality

We will keep confidential all business information shared with us during an Engagement. We will not disclose the content of a process map, document capture results, or details of your business operations to third parties without your consent, except where required by law.

We ask that you inform us before an Engagement if any documents or processes we will observe are subject to third-party confidentiality obligations, so we can handle them appropriately.

10. Disclaimers

  • Our Services are provided on an "as observed" basis. Process maps describe what we observed — they are not a guarantee that the business operates that way at all times
  • Document capture results depend on the readability of your specific document formats. We report limitations honestly but cannot guarantee capture rates for formats we have not tested
  • Training is provided in good faith based on current understanding of AI tools. These tools change rapidly; we do not warrant that our guidance will remain accurate indefinitely
  • We do not provide legal, accounting, or regulatory advice. Our observations about data privacy in AI tools are practical guidance, not legal advice

11. Limitation of Liability

Our liability to you in connection with any Engagement is limited to the amount you paid for that specific Engagement. We are not liable for:

  • Indirect or consequential loss
  • Loss of profit or business opportunity
  • Errors or omissions in information you provided to us
  • Outcomes resulting from your implementation decisions following delivery of a Deliverable

12. Governing Law and Disputes

These terms are governed by the laws of Malaysia. Any dispute arising from or related to these terms or an Engagement will first be addressed through direct negotiation. If a dispute cannot be resolved informally within 30 days, it may be referred to the appropriate court in Ipoh, Perak, Malaysia.

13. Changes to These Terms

We may update these terms. The terms in effect at the time your Scope Summary is issued govern that Engagement. Updated terms are published on this page with a new effective date. For material changes, active clients will be notified by email.
